TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of aiexplorers.academy and related services (the “Service”) provided by AI Explorers (“AI Explorers,” “we,” “us”). AI Explorers is an independent ed-tech program. OC Music & Dance is a customer that licenses AI Explorers for its own in-person program; OC Music & Dance does not operate the Service and is not a party to these Terms. By creating an account, purchasing a plan, or using the Service, you agree to these Terms.
1. ELIGIBILITY
You must be at least 18 years old to create a parent account or purchase a plan. By purchasing or registering, you confirm that you are the parent or legal guardian of any student you enroll, and that you are entering into these Terms on the student's behalf. You are responsible for the student's use of the Service.
2. ACCOUNTS
You are responsible for the accuracy of the information you provide and for safeguarding the credentials and student login codes associated with your account. Notify us promptly if you believe an account or code has been compromised. We may suspend or terminate accounts that violate these Terms.
3. PLANS, PAYMENT, AND CHANGES
Plans and prices are described on our enrollment pages. Payments are processed by Stripe. By purchasing, you authorize the charge as described at checkout. Prices, plan structures, and features may change; price changes will not affect a plan you have already purchased except as expressly disclosed at the time of purchase.
4. SCOPE OF ACCESS — “LIFETIME” / “UNLIMITED” ACCESS
When the Service describes access as “lifetime,” “unlimited,” “forever,” or “never expires,” that access is to the specific lessons, quizzes, and downloadable materials that comprise the AI Explorers course you purchased at the time of your purchase. You may watch those lessons, retake those quizzes, and download the certificate associated with that course as many times as you wish, at your own pace, without a deadline.
New courses are not included. If AI Explorers releases additional courses, lesson packs, modules, characters, or features in the future, those new materials may be offered as a separate purchase or under a separate plan. They are not automatically included in a previously-purchased plan unless we expressly state otherwise at the time we release them.
Existing materials may evolve. We may update, replace, or retire individual lessons or quizzes within an existing course (for example, to keep references to third-party AI tools current). We will not materially reduce the scope of a course you have already paid for without giving you reasonable advance notice.
End of program. If we ever discontinue the Service entirely or permanently retire a specific course, we will give parents reasonable advance notice. Continued availability of course materials for download or offline retention after discontinuation is provided only as required by applicable law; no separate download or archival right is granted by these Terms beyond that. “Lifetime” refers to the lifetime of the course as offered; it is not a guarantee that AI Explorers itself will operate forever.
Resetting progress. Students and parents may reset their own course progress at any time from the progress page. A reset only affects the resetter's own completion records on their own account; it does not affect any other learner on the same family plan, does not cancel or shorten the parent's or any student's ongoing access to the lessons in the plan, and is not a basis for a refund. The Certificate of Completion requires that all 16 lessons and their associated quizzes are marked complete on the earner's own account at the time the certificate is generated; if you reset your progress, you will need to re-watch the lessons and re-pass their quizzes before the certificate becomes downloadable again. A previously-issued certificate file remains valid as historical proof of past completion.

See our Refund Policy. The Refund Policy is incorporated into these Terms by reference.
6. ACCEPTABLE USE
You agree not to:
- Share, sell, or sublicense student login codes outside your immediate household.
- Reproduce, redistribute, or create derivative works from our lessons, videos, or quizzes outside the Service.
- Use the Service to harass others or to violate any law.
- Attempt to access another user's account, reverse-engineer the Service, or interfere with its operation.
- Submit false information at sign-up or onboarding.
7. COURSE CONTENT AND INTELLECTUAL PROPERTY
All lesson videos, quizzes, characters, scripts, illustrations, and text are owned by AI Explorers or licensed for our use. We grant you a limited, non-transferable, non-exclusive, revocable license to access and view the content for personal, non-commercial educational use during your active subscription. The license ends if your account is suspended or terminated.
Lesson guides are fictional. The student-guide characters that lead each lesson (including, without limitation, Atlas, Maya, Kai, Iara, Carter, Colette, Emilio, Mei, Nico, Haven, Jalen, Ananya, Luke, Soleil, Seo, and Audrey) are fictitious. Their names, personalities, voices, and backstories were created by AI Explorers for educational purposes. Any resemblance to real persons, living or deceased, is coincidental.
8. THIRD-PARTY SERVICES, TOOLS, AND PROGRAM PARTNERS
The lessons reference third-party AI tools and the companies that make them — including, without limitation, OpenAI (ChatGPT), Anthropic (Claude), Google (Gemini, Bard), Microsoft (Copilot), Midjourney, ElevenLabs, Stability AI, Runway, and others. AI Explorers is not affiliated with, endorsed by, sponsored by, or otherwise related to any of these companies. All product names, logos, trademarks, and brand marks are the property of their respective owners and are referenced for educational and informational purposes only, in a nominative and descriptive sense.
Subscriptions to third-party AI tools are not included with AI Explorers and are not required to complete the course. Any use of those tools is governed by the provider's own terms of service and privacy policy; AI Explorers does not control and is not responsible for those services. Statements about third-party tools in our lessons reflect our independent educational opinion at the time of recording and may become outdated as those tools evolve.
Third-party age requirements. Many of the AI tools referenced in our lessons impose their own minimum age requirements that are independent of, and may be more restrictive than, the eligibility rules for AI Explorers. For example, several major AI services require users to be 13 or older (or 18 or older in certain regions or for certain features) and may also require a parent or legal guardian to consent on behalf of a minor. It is the parent's responsibility to review each third-party tool's terms before allowing a student to use it and to ensure the student meets that tool's eligibility requirements. AI Explorers does not represent or warrant that any student is permitted to use any specific third-party tool, and AI Explorers is not responsible for a student's compliance with another provider's rules.
AI Explorers may also be delivered to you through a separate program partner (for example, OC Music & Dance for the in-person summer program). The program partner is its own operator with its own terms, fees, refund policies, and on-site rules. These Terms govern only your use of aiexplorers.academy; your participation with the partner is governed by the partner's separate agreement with you.
9. NO WARRANTIES
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted access. Educational content is for general informational purposes and is not a substitute for accredited instruction.
10. LIMITATION OF LIABILITY
To the maximum extent permitted by law, AI Explorers and our officers, employees, and contractors will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or lost goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) $100. Some jurisdictions do not allow these limits; in those jurisdictions our liability is limited to the smallest amount permitted by law.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AI Explorers (and our officers, employees, and contractors) from any claim, damage, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of another person's rights.
12. TERMINATION
You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will survive.
13. GOVERNING LAW; DISPUTES
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. The exclusive venue for any dispute that is not subject to binding arbitration is the state and federal courts located in Orange County, California, and the parties consent to personal jurisdiction there. You and AI Explorers each waive any right to a jury trial. The parties may agree to resolve disputes through binding individual arbitration; nothing in these Terms requires that absent a separate arbitration agreement.
Class action waiver. To the maximum extent permitted by law, you and AI Explorers each agree that any dispute, claim, or proceeding between us — whether brought in court or in arbitration — will be brought only in your or our individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator or court may not consolidate more than one person's claims and may not preside over any class or representative proceeding. If this class action waiver is held to be unenforceable as to any particular claim, then that claim (and only that claim) shall be severed from any arbitration and may proceed in court; the remainder of these Terms, including this waiver as to all other claims, will continue to apply.
14. CHANGES
We may update these Terms from time to time. The “Effective date” at the top will reflect the latest version. For material changes, we will notify parents by email. Continued use of the Service after changes take effect constitutes acceptance.
